Physically returning employees to work? 5 key questions to consider

As the lockdown restrictions continue to be relaxed by the government, many employers will increasingly be considering how to safely return employees to the physical workplace. 

Our partner, leading North East commercial law firm Muckle LLP, have put together a set of FAQs to help you keep that “business as usual” approach as far as possible.

Considerations for employers

Whilst health and safety will always be the primary consideration, there will also be practical challenges to consider, including how to balance the needs of those employees with health conditions, or who live with someone who is clinically vulnerable or those with caring responsibilities; supporting employees who rely on public transport to get to and from work and instilling confidence in employees who feel frightened about returning to the workplace.

To help with this, we have set out five key questions we consider employers should be asking themselves when planning the physical return to work and explain the legal issues that underpin them:

  1. Can your employees continue to work from home?
  2. Have you ensured, so far as is reasonably practicable, the health, safety and welfare at work of your employees?
  3. Have you engaged your employees and consulted with them about health and safety?
  4. What information will you need from employees to assess the risks?
  5. What you should consider if an employee refuses to return to work?
